Terms & Conditions

1. Acceptance of Terms

By creating a SnapFlow account, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, you may not use SnapFlow. These Terms form a legally binding agreement between you and the operator identified on our Imprint page.

2. Account Registration

  • You must be at least 16 years old to register. If you are under 18, you confirm that you have parental or guardian consent.
  • You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at our contact address if you suspect unauthorised access.
  • Each account is for a single user or, for corporate/agency accounts, a single organisation. You may not transfer your account to another person.
  • You agree to provide accurate registration information and keep it up to date.

3. Acceptable Use

You agree not to use SnapFlow to:

  • Upload, store, or distribute content that infringes any third-party intellectual property rights.
  • Upload, store, or distribute unlawful, defamatory, abusive, obscene, or otherwise objectionable content.
  • Reverse-engineer, decompile, or attempt to extract the source code of the service.
  • Use the service for any purpose that violates applicable law, including data protection regulations.
  • Probe, scan, or test the vulnerability of our systems without express written permission.
  • Circumvent any rate limiting or access controls imposed by the service.

We reserve the right to suspend or terminate accounts that violate these rules, without prior notice.

4. Subscription & Payment

  • Billing: Paid plans are billed monthly in advance. All prices are shown inclusive of any applicable VAT.
  • Auto-renewal: Your subscription renews automatically at the end of each billing period. You may cancel at any time from your account settings; cancellation takes effect at the end of the current period.
  • Payment providers: Payments are processed by Stripe or PayPal. We do not store your card details.
  • Price changes: We will give you at least 30 days' advance notice of any price change by email. Continued use after the effective date constitutes acceptance.
  • Free plans: Free plans are provided without charge and without any uptime or feature guarantee. We reserve the right to change free-plan limits with 30 days' notice.
  • Trials: Where a trial period is offered, you will not be charged during the trial. You may cancel before the trial ends to avoid any charge.
  • No refunds: Except where required by law (e.g. EU consumer right of withdrawal within 14 days for new subscriptions), all fees are non-refundable.

5. Data Ownership & Intellectual Property

  • Your content: You retain full ownership of all photos, albums, captions, and other content you upload to SnapFlow.
  • Licence to us: You grant SnapFlow a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the service to you. We do not claim any ownership rights over your content.
  • Deletion: When you delete your account, all your content will be permanently deleted from our systems within 30 days.
  • SnapFlow IP: The SnapFlow software, design, trademarks, and documentation are the property of the operator and may not be copied, reproduced, or used without express written permission.

6. Service Availability

SnapFlow is provided "as is" and "as available". We strive for high uptime but do not guarantee uninterrupted, error-free service. We recommend maintaining your own backups of critical photos. We will not be liable for any loss of data due to service interruptions, unless caused by our gross negligence or wilful misconduct.

7. Termination

  • By you: You may close your account at any time from your account settings. Your data will be deleted as described in Section 5.
  • By us: We may suspend or terminate your account for breach of these Terms, non-payment, or if required by law. Where possible we will give reasonable advance notice.
  • Effect of termination: Upon termination, your right to use SnapFlow ceases immediately. Sections 5, 8, and 9 survive termination.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our total aggregate liability for any claim arising out of or related to SnapFlow is limited to the fees you have paid in the three (3) months preceding the claim.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill — even if we have been advised of the possibility of such damages.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by German law.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of the operator's registered location (see Imprint).

If you are a consumer resident in the EU, you may also contact the EU Online Dispute Resolution platform for out-of-court dispute resolution.

10. Changes to These Terms

We will give you at least 30 days' advance notice of any material changes to these Terms by email. If you do not agree with the updated Terms, you may close your account before the effective date. Continued use after the effective date constitutes acceptance of the revised Terms.
